1. About these terms

These Terms & Conditions (“Terms”) govern your access to and use of the O&M Manuals platform (“Platform”), operated by P&B Perspective Ltd, a company registered in England and Wales (“we”, “us”, “our”).

By accessing or using the Platform you agree to these Terms. If you do not agree, do not use the Platform. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. The service

The Platform allows workspaces (installers, manufacturers, and building-services firms) to create, publish, and share Operations & Maintenance manuals with their clients and end-users. Features include structured content management, PDF generation, QR-code access links, and a device register.

During the beta period, the Platform is provided free of charge. We reserve the right to introduce subscription pricing with reasonable notice. We will notify workspace administrators by email before any paid tier becomes active.

3. Accounts and access

Access to the Platform is by invitation only. Workspace administrators are responsible for inviting and managing their team members and client users. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must not share your account credentials, attempt to access another user’s account, or circumvent any access controls.

4. Acceptable use

You agree not to use the Platform to:

  • Upload or transmit unlawful, defamatory, or infringing content.
  • Introduce malware, viruses, or other harmful code.
  • Attempt to probe, scan, or test the vulnerability of the Platform or its infrastructure.
  • Use the Platform in any way that disrupts service for other users.
  • Reverse-engineer, decompile, or attempt to extract the Platform’s source code.

5. Your content and data

You retain ownership of all content you upload to the Platform (“Your Content”). By uploading Your Content you grant us a limited, non-exclusive licence to store, process, and display it solely to provide the service.

Client organisations own their manual data. If a workspace relationship ends, client manual data remains accessible in read-only mode for a grace period of 12 months, after which it is deleted on request. You may export your data at any time using the full-export function available within the Platform.

You are responsible for ensuring that Your Content does not infringe the intellectual property rights, privacy rights, or other legal rights of any third party.

6. Intellectual property

The Platform, its design, software, and underlying technology are the property of P&B Perspective Ltd and are protected by intellectual property laws. Nothing in these Terms grants you any right to use our trade marks, logos, or branding.

7. Availability and changes

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features of the Platform with reasonable notice. We will endeavour to provide at least 30 days’ notice of any material change that affects your use of Your Content.

8. Limitation of liability

To the fullest extent permitted by law, P&B Perspective Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, loss of profits, or business interruption.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total fees paid by you (if any) in the 12 months preceding the claim, or £100, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by English law.

9. Governing law

These Terms are governed by the law of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to these terms

We may update these Terms from time to time. We will notify workspace administrators of material changes by email at least 14 days before the changes take effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms.
